Notice in terms of Article 88 of the Constitution

Notice is hereby given to the Assembly that the President, finding himself unable to assent to the Physical Planning Bill, 2019 for the reason that ‘Section 9(1)(a) therein requires that the Chairperson and seven Members of the Board of the Planning Authority be appointed on the recommendation of the Constitutional Appointments Authority. The Members of the Board of the Planning Authority are not constitutional appointees. The appointments are made by the Executive. The functioning of the Planning Authority is subject to auditing and to such oversight as may be exercised by the Legislature in accordance with the Constitution’, has, in terms of Article 88(1) of the Constitution, returned the Bill to the Assembly for approval.

In terms of Article 88(2), the Assembly is called upon to vote on the following resolution: ‘This Assembly resolves that the Physical Planning Bill, 2019 should again be presented for the President’s assent’.
